Section A – General Terms

  1. Introduction
    1. RX Click links you to the third-party pharmacies (“Vendors”) for you to purchase pharmaceutical goods (hereinafter collectively referred to as “Goods“)to be delivered to you. When you place an order for Goods from our Vendors (“Order”), RXClick acts as an agent on behalf of that Vendor to facilitate, process and conclude the order and subsequently for us to deliver your Order to you(hereinafter collectively referred to as “Services“) .
    2. These Terms of Use (“Terms”) govern your use of the websites and mobile applications provided by RX Click (or referred to as “us”) (collectively the “Platforms”). Please read these Terms carefully. These Terms of Use and the RX Click policies (as defined) constitute a legally binding agreement (“Agreement”) between you and RX Click. The Agreement applies to your use of the Service (as defined) provided by RX Click. By accessing and using the Platforms, you agree that you have read, understood and accepted the Terms including any additional terms and conditions and any policies referenced herein, available on the Platforms or available by hyperlink. If you do not agree or fall within the Terms, please do not use the Platforms.
    3. The Platforms may be used by (i) natural persons who have reached 18 years of age and (ii) corporate legal entities, e.g companies. Where applicable, these Terms shall be subject to country-specific provisions as set out herein.
    4. Users below the age of 18 must obtain consent from parent(s) or legal guardian(s), who by accepting these Terms shall agree to take responsibility for your actions and any charges associated with your use of the Platforms and/or purchase of Goods. If you do not have consent from your parent(s) or legal guardian(s), you must stop using/accessing the Platforms immediately.
    5. RX Click may amend the terms in the Agreement at any time. Such amendments shall be effective once they are posted on the Platforms. It is your responsibility to review the Terms of Use regularly. Your continued use of the Service after any such amendments, whether reviewed by you, shall constitute your agreement to be bound by such amendments.
  1. Definitions

In these Terms of Use, the following words shall have the meanings described below:

    1. Application” means the relevant mobile application(s) made available for download by RX Click to Users and Third-Party Providers respectively.
    2. RX Click” policies means the following:
      • The Privacy Policy
      • all other forms, policies, notices, guidelines, frequently asked questions (FAQs), or agreements provided to or entered into by you from time to time.
    3. Personal Data” is any information which can be used to identify you or from which you are identifiable. This includes but is not limited to your name, nationality, telephone number, bank and credit card details, personal interests, email address, your image, government-issued identification numbers, race, date of birth, marital status, religion, health information and other relevant data.
    4. Platform” means the relevant RX Click technology platform, or website that, when used in conjunction with the Application, enables Users to request or access our services.
    5. Third Party Provider” means the independent third parties who provide the services thru the Application and Platform.
    6. User” means any person who uses the Application and Platform.
    7. User Charges” shall mean charges incurred by Users for the use of services provided by the Application and Platform.
  1. Use of the Application and Platform
    1. You will only use the Application, Platform and Service for their intended and lawful purposes.
    2. You will keep your account password or any identification we provide to you which allows access to the Service secure and confidential.
    3. You will provide us with whatever proof of identity or any other documents which we may reasonably request or require.
    4. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
    5. You will not attempt to commercially exploit any part of the Application without our permission, including without limitation to modify any of the Application’s content in any way, or copy, reproduce, publicly display, distribute or otherwise use or communicate them for any public or commercial purpose without our permission.
    6. You will not use the Application and/or the Software to cause nuisance or behave in an inappropriate or disrespectful manner towards RX Click, third party vendors or our delivery personnel.
    7. General Medicine Supply

You will provide accurate, valid, current and complete information as required for the Service to the Pharmacist and undertake the responsibility to maintain and update your information in a timely manner to keep it accurate, current and complete at all times during the term of the Agreement. You acknowledge that if your information is untrue, inaccurate, not current or incomplete in any respect, RX Click has the right to terminate this Agreement and your use of the Service at any time with or without notice.

    1. Prescription-based Medicine Supply

You agree that when you placed an order for prescription medications, you will need to provide original and legit prescription to the pharmacy, and the pharmacy has the authority to reject your prescription order with valid reason. (Ex. Prescription did not meet the criteria according to pharmacy regulation)

    1. Recordings

RX Click requires all video conference between user and pharmacist to be recorded     for reference purpose. By using this Service, you are giving RX Click consent to store recordings for all video conferences performed with RX Click application in our systems. You will receive a notification (visual or otherwise) when recording is enabled.

  1. Intellectual Property
    1. All trademarks, logos, images, and service marks, including these Terms as displayed on the Platforms or in our marketing material, whether registered or unregistered, are the intellectual property of RX Click and/or third parties who have authorised us with the use (collectively the “Trademarks”). You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify these Trademarks in any way without our prior express written consent. The use of RX Click’s trademarks on any other website not approved by us is strictly prohibited. RX Click will aggressively enforce its intellectual property rights to the fullest extent of the law, including criminal prosecution. RX Click neither warrants nor represents that your use of materials displayed on the Platforms will not infringe rights of third parties not owned by or affiliated with RX Click. Use of any materials on the Platforms is at your own risk.
  1. Orders
    1. When you place an Order, RX Click will confirm your order by sending you a confirmation email or in app confirmation containing the Order receipt. Where applicable, Orders will include delivery fees and any applicable tax (e.g. goods and services tax, value-added tax, etc.).
    2. All orders are the responsibility of the Vendor. Please note that your Order may be subject to additional terms and conditions provided by the Vendor.
    3. Please contact us immediately via our in-app customer support chat feature if you wish to cancel your Order after it has been placed. You have the right to cancel your Order provided a Vendor has not yet accepted your Order.
  1. Prices and Payments
    1. Prices quoted on the Platform shall be displayed in the Malaysia Ringgit (RM) currency and subject to applicable tax. Prices are displayed in a range and the actual price will be given by the Vendor who accepts your order.
    2. A breakdown of the prices and additional charges are displayed before Checkout. When you place an Order, you agree to all amounts, additional charges and the final ‘Total’amount which is displayed to you.
    3. Delivery fees are chargeable on every Order unless:
      1. stated otherwise.
      2. you have a valid promotional or discount voucher and apply it at Checkout.
    4. Consumers are required to make full payment of the Consumer Charges for all services offered in the Application by the method selected at the time of booking, any one of the automated payment methods available to you on the Application. Any payment pursuant to such selection is non-refundable and irrevocable.
  1. Delivery
    1. Our Vendors offer their Goods in specific delivery areas and our Vendors vary from delivery area to delivery area. Delivery areas may expand, shrink or change depending on weather and traffic conditions and situations of force majeure.
    2. You may choose for your Order to be delivered “ASAP” or scheduled for a specific time. An estimated delivery time will be provided to you in your email confirmation but delivery times shall vary depending on factors that are not controlled by us (e.g. order quantity, distance, time of day (peak periods), weather conditions, traffic conditions, etc.). You can view the remaining delivery time of an Order when you click on ‘My orders’on the Platforms. You acknowledge that the delivery time we provide is only an estimate and Orders may arrive earlier or later. To ensure that you do not miss a delivery of an Order, you should ensure that either you or someone is at the delivery location to receive the Order once an Order is placed.
    3. For medication, the person whose name is on the prescription must be present during delivery to countercheck the NRIC or other relevant identifications.
    4. For people receiving on behalf, necessary details will be taken for countercheck purposes.
    5. In cases where we attempt to deliver an Order but we are unable to do so due to the reasons caused by you, including but not limited to:
      1. no one was present or available to receive the Order; or
      2. customer was uncontactable despite attempts to reach the customer via the phone number provided; or
      3. lack of appropriate or sufficient access to deliver the Order successfully; or
      4. lack of a suitable or secure location to leave the Order; or
      5. no original prescription or relevant identification documents for prescription items.

If you remain uncontactable or fail to receive the items ordered within ten (10) minutes from the time it arrives at your delivery address, the items will be resend to the pharmacy responsible and you will receive notification to collect your items from the respected pharmacy.

  1. Vouchers, Discounts and Promotions
    1. From time to time, RX Click may run marketing and promotional campaigns which offer voucher codes, discounts, and other promotional offers to be used on the Application and Platform (“Vouchers”). Vouchers are subject to validity periods, redemption periods, and in certain cases, may only be used once.
    2. Vouchers may not be valid when used in conjunction with other promotions, discounts or other vouchers. Additional terms and conditions may apply to Vouchers.
    3. Unless otherwise stated, Vouchers can only be used on our Platforms.
    4. Vouchers cannot be exchanged for cash.
    5. RX Click reserves the right to void, discontinue or reject the use of any Voucher without prior notice Individual restaurants terms & conditions apply.
    6. We may exclude certain Vendors from the use of Vouchers at any time without prior notice to you.
  1. Representations and Warranties
    1. You acknowledge and agree that the content on the Platforms are provided on an “as is” and “as available” basis, and that your use of or reliance upon the Platforms and any content, goods, products or services accessed or obtained thereby is at your sole risk and discretion. While RX Click makes reasonable efforts to ensure the provision of the Platforms and the services we offer, are available at all times, we do not warrant or represent that the Platforms shall be provided in a manner which is secure, timely, uninterrupted, error-free, free of technical difficulties, defects or viruses. Please expect temporary interruptions of the Platform due to scheduled or regular system maintenance work, downtimes attributable to internet or electronic communications or events of force majeure.
    2. We do not make any representations with regards to the accuracy, appropriateness and safety of the pharmaceutical product offered by vendors and Services rendered via our mobile app and website. RX Click will not be responsible for any losses or damages caused by the products purchased by customers. Any and all representations made on our mobile app and website are of general nature. You acknowledge that the effect of a particular pharmaceutical product may vary among individuals and there is a possibility that you are allergic to certain ingredient in the pharmaceutical product. You acknowledge and agree that you are solely and fully responsible to seek the necessary medical consultation and/or advice regarding the accurateness, appropriateness and safety of all pharmaceutical product intended to be ordered by you and Services rendered by us via the mobile app and website and that you do not rely on any form of representation by us.
  1. Limitation of Liability
    1. To the extent permitted by law, RX Click (which shall include its employees, directors, agents, representatives, affiliates and parent company) exclude all liability (whether arising in contract, in negligence or otherwise) for loss or damage which you or any third party may incur in connection with our Application and Platform, our services, and any website linked to our Application and Platform and any content or material posted on it. Your exclusive remedy with respect to your use of the Platforms is to discontinue your use of the Platforms. RX Click entities, their agents, representatives, and service providers shall not be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use of the Platforms or for any other claim related in any way to your use of the Platforms. These exclusions for indirect, special, consequential, and exemplary damages include, without limitation, damages for lost profits, lost data, loss of goodwill, work stoppage, computer failure, or malfunction, or any other commercial damages or losses, even if the RX Click entities, their agents, representatives, and service providers have been advised of the possibility thereof and regardless of the legal or equitable theory upon which the claim is based. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, RX Click, the RX Click entities, its agents, representatives and service providers’ liability shall be limited to the extent permitted by law.
  1. Vendor Liability
    1. Vendors are responsible for the packing, condition and quality of Goods.
  1. Personal Data (Personal Information) Protection 
    1. You agree and consent to RX Click and any of its affiliate companies collecting, using, processing and disclosing your Personal Data in accordance with these Terms and as further described in our Privacy Policy. Our Privacy Policy is available via the links on our Application and Platform shall form a part of these Terms.
  1. Third Party Links and Websites
    1. The Application and Platform may contain links to other third-party websites and by clicking on these links, you agree to do so at your own risk. RX Click does not control or endorse these third-party websites or links and shall not be responsible for the content of these linked pages. RX Click accepts no liability or responsibility for any loss or damage which may be suffered by you in relation to your access and use of these third-party links and websites.
  1. Termination
    1. RX Click has the right to terminate, suspend or delete your account and access to the Application and Platform, including any delivery service we provide to you in respect of an Order, for any reason, including, without limitation, if RX Click, in its sole discretion, considers your use to be unacceptable, or in the event of any breach by you of the Terms. RX Click may, but shall be under no obligation to, provide you a warning prior to termination of your use of the Application and Platform.
  1. Severability
    1. If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any provision in these Terms of Use shall be deemed a further or continuing waiver of such provision or any other provision.


Return / Refund

If customers discovers that there are issues with the Order (e.g. wrong order, defective order, or missing items) please contact customer support via the communication mediums provided. In some cases, RX Click may request for photographic proof and/or additional information to properly investigate the issue with the Order. If we determine that the Order and/or Items received are not of satisfactory condition or quality, we will compensate our customer your based on the terms and conditions of this stated policy.

Terms & Conditions of Return/Refund

Returns are accepted if:

      1. Item(s) received does not match the order.

Returns request must be submitted immediately thru our app or direct contact with our Customer Service. Replacement for the damaged item (s) is subject to availability in stock. In absence of a replacement, a refund will be issued after thorough investigation.

      1. Item(s) were damaged in transit or shortage.

If you notice the package is damaged at the time of delivery, please do not accept the order if the seal is broken. If you could not check that the order is damaged at the time of delivery, raise a return request within 24 hours of delivery thru our app. Replacement for the damaged item (s) is subject to availability in stock. In absence of a replacement, a refund will be issued after thorough investigation.

      1. Item(s) are due to expire in 3 months. Customer can make an exchange request to RX Click through our customer service.

Note: If you notice the package is damaged at the time of delivery, please do not accept the order if the seal is broken. If you could not check that the order is damaged at the time of delivery, raise a return request within 24 hours of delivery thru our app. Replacement for the damaged item (s) is subject to availability in stock. In absence of a replacement, a refund will be issued after thorough investigation. Items can be returned within 24 hours from the time order is received.

Returns/Exchange/Replacement/Refund request are subjected to the following conditions:

  1. Items being returned should only be in their original manufacturer’s packaging i.e. with labels, bar-code.
  2. Only fully unused strips/bottles can be returned.
  3. Batch number of the product being returned should match as mentioned on the sales invoice.
  4. Customer attached pictures of damaged or affected item or broken seal through RX Click app.

Replacement items will be delivered within 24 – 48 hours from the time a return request has been made to our customer service. This is subjected to stock and rider availability.

Refund process:

  1. Refund process will only begin after RX Click received the confirmation item(s) has been received by the client pharmacy.
  2. Product Complaint Services will conduct a detail investigation after the customer lodged the complaint.
  3. The refund process investigation will be completed within 3 working days. Thereafter, once refund is approved in that particular case, customer will be notified via email. Payment will made to customer’s designated bank account or customer’s RX Click e-wallet, whichever is applicable (within 7 business days) of approval date.

For refunds, customer will be requested to provide or verify name, bank name, and bank account number.
Both return and refund process will also all be communicated via email.

Shipment processing time
All orders are processed within 2 hours. If we are experiencing a high volume of orders, shipments may be delayed. Please allow additional ONE hour in transit for delivery. If there will be a significant delay in shipment of your order, we will contact you via email or telephone.

Shipping rates & delivery estimates
Shipping charges for your order will be calculated based on our Third Party delivery Partner (Lalamove/Grab) and will be displayed at checkout.

Shipment confirmation & Order tracking
You will receive a Shipment Confirmation email once your order has shipped containing your tracking number(s).

If you received your order damaged, please contact our customer service to file a claim.
Please save all packaging materials and damaged goods before filing a claim.
